Terms of Service

These terms and conditions ("Terms") govern your use of the Kayzaart website (the "Website") and the services provided by Kayzaart ("we," "us," or "our"), including the sale of digital art and game assets. By accessing or using the Website and purchasing our products, you agree to be bound by these Terms. Please read them carefully.

1.   Intellectual Property: 1.1 All digital art, game assets, and other content available on Kayzaart are protected by intellectual property rights, including copyrights and trademarks. 1.2 By purchasing digital art or game assets from Kayzaart shop, you acquire a non-exclusive, non-transferable license to use the purchased item for personal or commercial purposes, as specified in the license agreement accompanying the item. You may not copy, resell, distribute, adapt or modify the purchased item without explicit permission. 1.3 If you hire Kayzaart for a specific project via our quotation form you will have exclusive rights to the work provided to you. 

2.    Prohibited Conduct: 2.1 You agree not to engage in any activity that violates these Terms or applicable laws, including but not limited to: a. Uploading or sharing content that infringes upon the intellectual property rights of others. b. Using the Website in a manner that may disrupt its operation, impair the experience of other users, or introduce malicious software or code. c. Attempting to gain unauthorized access to any part of the Website or other users' accounts. d. Engaging in any fraudulent or deceptive activities.

Payments and Refunds:

3.    Digital Products: 3.1 All prices for digital art and game assets are listed in the currency specified on the Website and include any applicable taxes. 3.2 Payments must be made through the designated payment methods provided on the Website. You agree to provide accurate and complete payment information. 3.3 We do not store your payment information on our servers. All payment transactions are processed by third-party payment processors, and their terms and conditions govern the transaction. 3.4 All sales of digital art and game assets are final. We do not offer refunds unless explicitly stated otherwise or required by applicable law.

3.5 Digital Product Refund Policy (If you have any questions about our products, feel free to email us at kayzaart.customer@gmail.com before making your purchase). 3.6 Since www.kayzaart.com offers non-tangible irrevocable goods we DO NOT issue refunds once the order is completed, and the product download link is sent. As a customer, you are responsible for understanding this upon purchasing any item at our site. 3.7 However, we realize that exceptional circumstance can take place with regard to the character of the product we supply. Therefore, we DO honour requests for the refund for the following reasons: 1) Specific terms stated on a specific digital product: Some digital products may explicitly state a full or partial refund is based on a satisfaction guarantee. 2) Non-delivery of the product: due to some mailing issues of your e-mail provider or your own mail server you might not receive a delivery e-mail from us. In this case, we recommend contacting us for assistance. Claims for non-delivery must be submitted within 7 days from the order placing date. Otherwise, the product will be considered received and downloaded. 3) Download and unzipping issues: it may happen so that you are having problems while downloading the product or its unzipping. Claims regarding such issues must be submitted within 7 days. If you do not properly contact us during this period, you agree that we may construe silence as a successful download of the product with no further right of redress or refund for a “download issue” reason. 4) Major defects: although all the products are thoroughly tested before release, unexpected errors may occur. You should contact us for such issues. We reserve the right to rectify the error or defect within 72 hours. If any deficiency is approved and we fail to correct it within 72 hours from the date of the initial complaint letter or any other notification provided by a Customer, the refund will be issued to the customer in full without any compensations or reimbursements. OR, at customer’s choice, replacement of the product of the same or around the same value can be offered; Please be advised that temporary access to your webhost/server can be requested by our technicians in order to identify and fix the possible issues with our products. Failure to provide such access in a timely manner may result in a delayed resolution of the issue. Refusal to provide access to your server will result in your inability to qualify for a refund. 5)Product not-as-described: such issues should be reported within 7 days from the date of the purchase. Clear evidence must be provided proving that the purchased product is not as it is described on the website. Complaints which are based merely on the customer’s false expectations or wishes are not honoured. 3.8 Please note that we do not bear any responsibility and therefore we do not satisfy any refund/return/exchange requests based on incompatibility of our products with some third-party software (plug-ins, add-ons, modules, search engines, scripts, extensions etc) other than those which are specified as compatible in a description available on the sales page of each product. We don’t guarantee that our products are fully compatible with any third-party programs (including web host) and we do not provide support for third-party applications. 3.9 Requests for a refund are accepted at kayzaart.customer@gmail.com within the period of 1 week after the order is placed. You should accompany this request with detailed and grounded reasons why you are applying for a refund. Please make sure your request does not contradict our Terms of Use/Privacy Policy.

4. Physical Product Refund/Returns Policy: 4.1 Any claims for misprinted/damaged/defective items must be submitted within 21 days after the product has been received. For packages lost in transit, all claims must be submitted no later than 10 days after the estimated delivery date. Claims deemed an error on our part are covered at our expense. 4.2 Wrong Address - If you provide an address that is considered insufficient by the courier, the shipment will be returned to the facility. You will be liable for reshipment costs once we have confirmed an updated address with you (if and as applicable). 4.3 Unclaimed - Shipments that go unclaimed are returned to our facility and you will be liable for the cost of a reshipment to yourself (if and as applicable). 4.4 We do not accept returns of sealed goods, such as but not limited to face masks, which are not suitable for return due to health or hygiene reasons. You hereby agree that any returned orders with face masks won’t be available for reshipping and will be disposed of. 4.5 For Returns: Please contact us before returning any products; kayzaart.customer@gmail.com 4.6 We do not offer size/type exchanges, so please ensure your product is the correct size/type. 4.7 Notification for EU consumers: According to Article 16(c) and (e) of the Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, the right of withdrawal may not be provided for: 1) the supply of goods that are made to the consumer's specifications or are clearly personalized; 2) sealed goods which were unsealed after delivery and thus aren't suitable for return due to health protection or hygiene reasons.

5.    Disclaimers: 5.1 The Website and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. 5.2 We make no guarantees regarding the accuracy, completeness, reliability, or availability of the content on the Website. 5.3 We disclaim any liability for any errors or omissions in the content or for any loss or damage incurred as a result of your use of the Website or reliance on its content.

6.    Termination: 6.1 We reserve the right to suspend or terminate your access to the Website and services at any time without prior notice if you violate these Terms or engage in any conduct that we deem harmful to the Website or other users.

7.    Governing Law and Jurisdiction: 7.1 These Terms shall be governed by and construed in accordance with the laws of European Parliament. 7.2 Any disputes arising out of or in connection with these Terms or the use of the Website shall be subject to the exclusive jurisdiction of the courts in European Parliament.

8.    Modifications to the Terms: 8.1 We reserve the right to modify or amend these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on the Website. 8.2 It is your responsibility to review the Terms periodically. Your continued use of the Website after any modifications signifies your acceptance of the updated Terms.

9.    Severability: 9.1 If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

10. Entire Agreement: 10.1 These Terms constitute the entire agreement between you and Kayzaart regarding your use of the Website and the purchase of digital art, illustrations, and game assets, superseding any prior agreements or understandings.
